On the last day of April, the Supreme Court handed down two
decisions reversing the Court of Appeals for the Federal Circuit.
One decision addresses "software as a component", and makes the
conjoint copyright/patent protection of computer software even
more interwoven. The other unanimously rejected a Federal Circuit
rule on proof of obviousness. The resulting shake-up in patent
litigation and the fallout in patent prosecution are just
beginning.
This CLE will address both decisions, with a pair of innovative
presenters tackling one each. John Vandenberg of Klarquist
Sparkman will examine the impact of Microsoft Corp. v. AT&T Corp.
on the foreign reach of U.S. patents; at halftime, Professor Joe
Miller of Lewis & Clark Law School will confront KSR Int'l Co. v.
Teleflex Inc. and its changes to the analysis of a claimed
invention's obviousness -- including possible effects on the
patentability of software inventions.
