The Fourth Amendment and the Internet - Recent Developments
The growing utilization of the Internet for business communications and data storage is fertilizing new search & seizure questions, and they're popping up like Spring flowers. Here are just a few:
Can information about the geographical location from which an Internet message was posted be subject to a reasonable expectation of privacy? Is externally-hosted company mail, such as a Google-hosted mail domain or hosted Exchange, "disclosed" already? In the absence of explicit contract terms, does a hosted mail provider have the power to destroy backups at some point? Does the Stored Communications Act (Title II of the Electronic Communications Privacy Act) make a distinction between opened and unopened electronic mail? Should we be surprised that pre-lawsuit identification subpoenas authorized under the DMCA have Google hiring extra legal help just to process such subpoenas? It's as if the tulip fields are blooming...
Picking a few of these and displaying the resulting bouquet will be Joesph Metcalfe of the University of Oregon School of Law. Before joining the law school faculty in 2002, Mr. Metcalfe worked for the Department of Justice, Criminal Division, Computer Crime and Intellectual Property Section, in Washington, D.C. His area of practice involved the intersection of new technologies, cyberspace and criminal law. Mr. Metcalfe worked for six years as a trial and appellate attorney with the Public Defender Service for the District of Columbia and as an adjunct professor at Georgetown University Law Center.
When: Thursday, April 19th, 12:00 p.m. to 1 p.m.
Where: Greek Cusina Restaurant, 404 SW Washington Street, Portland, in the Minoan Room on Floor 2, above the Mezzanine. Enter through Pacific Building on Washington Street & take the elevator to the second floor.
