Presentation
Oregon State Bar Computer and Internet
Law Section
TOPIC: Ouch! The Awkward Legal Problems of Open
Source Developers
SPEAKER: Bart Massey (http://www.cs.pdx.edu/~bart)
is an Associate Professor of Computer Science at
Portland State University, proprietor of bart-massey.com
LLC, and Technologist in Residence at the Open
Technology Business Center. Professor Massey has been an
open source developer for more than 20 years (since
before there were fancy names for it) and has followed
the evolution of software law over 30 years. He has
consulted on IP and other issues with law firms in the
Portland area. Professor Massey's current research areas
involve open source software engineering,
hardware/software systems, and artificial intelligence.
PRESENTATION DESCRIPTION: Traditionally, legal
authority flows from three sources: legislation,
precedent, and regulation. The world of open source
software moves too quickly for legislation to keep up,
and is too arcane for effective regulation: these
problems contribute to a lot of missing and bad
precedent. The result, from the developer's point of
view, is a painful mess.
In this talk, Professor Massey will give an
on-the-ground view of the legal issues that force many
open source developers into a side avocation as
poor-quality lawyerettes. He'll reveal what he tells
beginning open source developers about the pragmatics of
relevant law, and give examples of the issues facing
advanced open source developers, touching on GPL v3,
integration of open source code, the patent morass, and
DRM.

(including Q&A) by 1:00 p.m.
